1. Products and personalisation
Each personalised artwork is composed from your audio, text and selected options. The summary specifies the medium, size, orientation, quantity and price. Canvas dimensions differ from paper dimensions; the size displayed for the selected medium applies. Room mockups and textures are illustrative. Normal screen colour differences never remove your rights where goods do not conform. Collection artworks are not offered for sale until availability and commercial rights are confirmed.
2. Prices and destinations
Prices are in euros, inclusive of applicable taxes and Standard delivery to supported destinations. The total is shown before payment. Supported delivery countries appear on the Delivery page; Cyprus and Malta are not open. Overseas territories and special tax zones are excluded from this offer. Prices of concluded orders cannot be changed retrospectively.
3. Ordering and payment
You can edit the artwork and correct your details before continuing. Acceptance boxes are not preselected. Full payment is made on Stripe’s secure page. The contract is concluded when payment is confirmed; unpaid orders do not enter production. An email confirms the reference, specifications, amount, applicable terms and tracking link. The applicable terms and their version are stored with the order. Keep this email.
4. Review, production and delivery
Vocavas reviews the file before production. If a correction or approval is needed, we contact you; substantial changes require your agreement. Delivery: no more than 14 calendar days after payment, subject to any customer proof approval expressly agreed before ordering. If delivery is late, statutory remedies apply, including termination after a reasonable additional period, or immediately where an essential date or legal conditions allow. Risk of loss or damage remains with the seller until the consumer takes physical possession, except where the carrier was independently chosen rather than offered by the seller.
5. Personalised goods and withdrawal
Artworks made from your audio, text and choices are clearly personalised: Article L.221-28(3) of the French Consumer Code excludes the 14-day withdrawal right for these goods. This exception does not limit statutory guarantees or remedies for defects or failure to perform. You may request cancellation before production; any acceptance depends on actual preparation progress. Any future non-personalised product will have the applicable withdrawal terms and form before it is offered for sale.
6. Statutory guarantees
Consumers have two years from delivery to invoke the statutory conformity guarantee when a defect appears. During this period, consumers need establish only the existence of the defect, not when it appeared. Where the sale includes continuous digital content or a digital service for longer than two years, that content or service is covered throughout the agreed supply period. Consumers need establish only that the digital content or service is defective, not when the defect appeared. The conformity guarantee requires the trader, where applicable, to provide all updates necessary to maintain conformity. Consumers are entitled to repair or replacement within thirty days of their request, free of charge and without major inconvenience. A repair under the conformity guarantee extends the original guarantee by six months. If the consumer requests repair but the seller imposes replacement, the conformity guarantee restarts for two years from replacement. Consumers may keep the goods with a price reduction or terminate the contract for a full refund against return where: 1. The trader refuses repair or replacement; 2. Repair or replacement takes more than thirty days; 3. Repair or replacement causes major inconvenience, including when the consumer permanently bears collection, removal or installation costs; 4. Non-conformity persists despite an unsuccessful attempt to remedy it. A sufficiently serious defect also entitles consumers to an immediate price reduction or termination without first requesting repair or replacement. Termination is not available for a minor defect. Any period during which goods are unavailable for repair or replacement suspends the remaining guarantee until the remedied goods are delivered. These rights arise under Articles L.217-1 to L.217-32 of the French Consumer Code. A seller obstructing the guarantee in bad faith may face a civil fine of up to €300,000, which can be increased to 10% of average annual turnover (Article L.241-5). Consumers also benefit from the hidden-defect guarantee under Articles 1641 to 1649 of the French Civil Code for two years after discovering a defect. It permits a price reduction when keeping the goods or a full refund against return. English translation of the statutory French notice, Annex A to Article D.211-2 of the Consumer Code. Mandatory protections in the consumer’s country of residence remain applicable.
7. Listening service and privacy
Listening included with no scheduled expiry, for as long as the Vocavas listening service operates. Deletion on request. Any permanent service closure will be announced in advance with an option to retrieve the file, without prejudice to statutory rights. The QR opens a page without an app; a modern browser and internet connection are required. Anyone with the QR or link can listen and potentially copy the sound: the link is not an authentication mechanism. The source file is stored separately from public site files. A deletion requested by the owner ends playback; we explain the consequences before executing it. Outages are addressed diligently; statutory rights concerning the associated digital service remain applicable.
8. Content rights
You confirm that you have the necessary permissions to provide voices, music and text to Vocavas and commission the artwork. Obtain appropriate permission for other people’s or children’s voices. Do not submit unlawful content or unnecessary sensitive information. You grant only the rights needed to fulfil the order and provide the requested listening service. Accepting these terms does not authorise advertising use of your artwork or sound.
Complaints and mediation
First send your complaint to bonjour@vocavas.com with the order reference. If our reply to your written complaint is unsatisfactory, or if we do not reply within two months of it being sent, you may refer the dispute free of charge to the consumer mediator appointed by Lijane Solutions, subject to legal admissibility requirements: Centre de la Médiation de la Consommation de Conciliateurs de justice (CM2C) · 49 rue de Ponthieu, 75008 Paris, France · https://www.cm2c.net/. Referral must be made within one year of the written complaint. Mediation is optional for consumers; you retain the right to bring proceedings before a competent court.
9. Applicable law and records
French law applies without depriving consumers of applicable mandatory protections in their country of habitual residence. No exclusive French court jurisdiction is imposed. Electronic contracts of at least €120 are retained and available on request for ten years under applicable legal rules. Necessary payment records and contractual evidence are archived with restricted access.
